Regulatory documents of the Arbitration Court

Referral service of Arbitration court before SerpCCI is a quick and easy process. To ensure that your case will be heard by the Arbitration Court, you must include in the text of your main contract, the following arbitration clause, or to conclude on this subject a separate agreement (the agreement):

"Any dispute, controversy or claim which may arise out of or in connection with the present contract (agreement), or the execution, breach, termination or invalidity thereof, shall be settled by the Arbitration Court before the Chamber of Commerce and Industry of the Russian Federation in accordance with its Rules and Regulations. The arbitration court shall not pass copies of documents and other materials to the parties, as well as other information provided to the Arbitration Court by the parties. The decision of the Arbitration Court before the SerpCCI shall be final and binding on the parties to fulfill within the time specified in the decision of the arbitral tribunal. "

Note. The arbitration clause may also include the condition of undisputable and acceptance-free write-off from the account of non-prevailing party as a guarantee of the voluntary execution of the Arbitration Court, and can be formulated as follows:

"The parties herewith agreed to undisputable and acceptance-free write-off sums of money from their account, in accordance with the decision of the Arbitration Court in the event of default of the decision on a voluntary basis and to notify banking agencies, which are duly at their service by notification letter (the letter indicates these agencies are attached to this agreement) ".

Example of the Agreement to submit the dispute to the previously signed agreement to arbitration:

"LLC Malva, duly represented by Ivan Ivanov, acting on the basis of the Charter, of the one part, and

JSC" Gamma ", duly represented by Sergei Sergeyev, the Director acting on the basis of the Charter, of the other hand, concluded this Agreement as follows:

Submit a dispute arising on the basis of the sale and purchase agreement № 23/12 dated 28, March 2011 to the Arbitration Court before the SerpCCI.

The parties agreed that the Arbitration court shall not send copies of documents and other materials to the parties, as well as other information provided by the parties to the Arbitration Court. The decision of the Arbitration Court shall be final and is not a subject to dispute.
